1. Offer Overview

This Downlights Upgrade Offer (“Offer”) is provided by FREEWATTS PTY LTD (ABN: 65 658 372 000) to eligible customers in New South Wales (NSW), Australia. The Offer provides installation of accredited LED downlights under the Home Energy Efficiency Retrofits (HEER) method of the NSW Energy Savings Scheme (ESS), subject to the terms and conditions below.

2. Eligibility Criteria

The Offer is only available where all of the following eligibility criteria are met:

2.1 Location

• Installation must occur at a site located within NSW, Australia.

2.2 Site Type

• Applicable to residential dwellings and small business sites only.

• A small business must have annual electricity consumption below 100 MWh, verified via a scanned electricity bill.

2.3 Minimum Quantity

• A minimum of 20 LED downlights must be replaced to qualify for the Offer pricing.

• There is no upper limit on the number of lights replaced, subject to site suitability and inventory availability.

2.4 NSW ESS Program Status

• The Offer is subject to the availability and continuation of the NSW ESS HEER method for lighting activities (e.g., E1, E3, E5, E13) under the ESS Rule.

• FREEWATTS reserves the right to modify or withdraw the Offer if ESS program rules, accreditation, or activity eligibility change.

2.5 Stock Availability

• Offer pricing and installation are contingent on stock availability of ESS-accredited LED downlights.

• If appropriate accredited LEDs are unavailable at the time of installation, the Offer may need to be amended or cancelled.

2.6 Licensed Electrician Requirement

• Installations will only be undertaken on sites where FREEWATTS has a licensed electrician-holder participating in NSW. The licensed electrician must perform or supervise all electrical work.

3. Product & Installation Specifications

3.1 Ceiling & Fitting Conditions

• Pricing is based on installations in standard height ceilings (≤3 m) with standard removable light fittings.

• No additional wiring, ceiling modification or structural works are included unless expressly quoted.

3.2 Existing Light Compatibility

• Downlights being replaced must be halogen downlights of 35W or 50W.

• Existing transformers must be compatible with the new LED downlights per supplier compatibility lists.

3.3 Dimmers

• All dimmer switches must be disabled.

  • $20 (incl. GST) to disable per dimmer, or

  • $75 (incl. GST) to replace with a compatible dimmer.

3.4 Installation Access & Working Conditions

• All light fittings must be functional, accessible, and safe to work on from inside the premise.

• Installers may refuse work or impose additional costs where access is restricted or poses a safety hazard.

4. Compliance & Documentation

To comply with the ESS HEER method, the following documentation and evidence are required:

4.1 Evidence Collection

• Photographic evidence of both the existing lights and the newly installed LED downlights.

• Customer Nomination Form and Post-Implementation Declaration must be completed and signed by the site owner/occupier and the licensed electrician.

4.2 Recycling & Disposal

• All removed lighting equipment must be collected and disposed of in accordance with NSW ESS recycling requirements for lighting equipment.

4.3 Electrical Compliance Records

• The licensed electrician must supply valid Certificate of Compliance for Electrical Work (CCEW) or equivalent documentation.

5. Payment Terms

• Accepted payment methods: Bank Deposit, Credit Card, PayPal.

• Cash is not accepted.

• Pricing includes GST and installation labour.

6. Site Conditions & Risks

6.1 Dust, Paint & Breakage

• Ceiling dust may fall during installation; installers are not responsible for cleaning ceilings or paint damage where existing fittings have been painted in place.

• Despite careful handling, some halogen globes or fluorescent tubes may break during removal. Installers will remove and recycle broken components safely.

6.2 New Light Locations

• FREEWATTS will not install new light points where there were previously none as part of this Offer.

• If a contractor undertakes such works, it is outside the FREEWATTS scope and charged separately.

7. Post-Installation Adjustments

• Customers must verify replacements before installers depart.

• If after departure a light is reported as not replaced, a $150 call-out fee plus the cost of replacement applies.

8. Replacement of Existing Accredited LEDs

• Any existing LED downlight replaced with another LED from FREEWATTS but outside the ESS scheme will be charged at $30 per light.

9. Limitations & Cancellations

• FREEWATTS may cancel or suspend installations where ESS program compliance cannot be met or stock is unavailable.

• Pricing and the Offer do not apply where ESS HEER lighting activities are ceased or no longer accredited.

10. Definitions

• • ESS: NSW Energy Savings Scheme.

  • HEER: Home Energy Efficiency Retrofits method within the ESS.

  • ACP: Accredited Certificate Provider under the ESS.

  • ESC: Energy Savings Certificate created under the Scheme.

• LED lights come with a 1 year manufacturer’s warranty unless specified otherwise.
  • In the case that the product is no longer available on the market, a similar product will be supplied.
• One-year-warranty on the labour.
